These terms and conditions outline the rules and regulations for the use of Arpan Sen Network's Services.
The following terms of service refer to the products and services offered by Arpan Sen Internet Services, LLC in exchange for the fees paid by you (the customer). The terms "Arpan Sen Network" or "Arpan Sen Internet Services, LLC" or "us" or "we" refer to Arpan Sen Internet Services, LLC.
While placing an order with us, we require you to register an account with us on our billing panel where we ask for the following: -A valid phone number; a valid address; an email address where we can reach you; Your legal name
We require you to give us the above personal information so we can process your order with us and be able to contact you regarding said services. In the event that we find that the given information is incorrect, we reserve the right to cancel your services or mark said services as fraud without any refunds. We may also reach out to you in the event of any abuse of our services, in which case we may contact you via the email address provided. Providing false information regarding your account may result in your account being terminated and we are not responsible for any damages caused. In some cases, we may also ask you to identify yourself and ask for your government-issued identification. Failure to provide the same may result in the suspension of your account and the termination of your services with us.
You agree to take full responsibility regarding the data you choose to store and/or host on our infrastructure, including any scripts/programs or any other media content of the same sort. You further agree to comply with the law while hosting content on our infrastructure and take down any content that may violate such laws. We do not allow any phishing, spam, or wirez content to be hosted on our network. In any case where we may find that the above mentioned duties are not being fulfilled, we may choose to terminate your services with us with or without notice.
You agree to give us the appropriate payment information for the services you order from us and supply us with the payment before you receive said services. Furthermore, you agree to pay for said services until the end of your contract for the service, and you agree to notify us of your desire to cancel your service at least 72 hours before the renewal of said contract. Failure to do so will result in your contract being renewed and you oweing us the due amount for said contract.
Cancellations must be done either via ticket or via the cancel button on our billing panel. Any cancellation requests that are approved are counted from the time when the ticket was initially created.
Arpan Sen Internet Services, LLC holds the right to change the recurring payment amount at any given time with at least a 7-day notice before the change.
Invoices that have been paid for more than once will be added as credit only. The credit added will be the deducted sum of the payable invoice amount.
Arpan Sen Internet Services, LLC holds the right to cancel or terminate any of your accounts or services at our own discretion at anytime with or without notice and without a refund. Foul language or behaviour towards our staff or any of our partners will result in us not renewing your contract with us.
We offer a full refund for any service ordered within the last 24 hours without any justification required. However, there may be cases where we may choose not to offer a refund for your service at our own discretion.
We do not offer any withdrawals of the credit in your account. Credits on your account must be used on services within our range of services that we offer.
We may offer unlimited/unmetered resources with our services. If you buy a service with an unlimited resource, we may track the usage of said resource and limit its usage based on the impact of your usage of said resource on our other clients on the same node. If you buy a service with an unmereted resource, you may use it as much as you want to the point where it does not saturate our resources or exceed what we may deem "fair".
If you are found to be exceeding what we deem "fair," we may limit said resource until the end of the contract term. We may also cancel your service entirely if you are found to be repeatedly exceeding quotas and/or causing disturbances on our network/infrastructure.
We offer 99% uptime within the service term for the services we provide, outside of physical hardware maintenance. In the event we fail to meet this expectation, you are eligible to receive a small amount of credit for the inconvenience caused. This downtime credit is given to a user only after said credit has been requested by the user themselves, which must be approved first by us depending on the justification given by the user.
We use a wide range of both third-party and first-party monitoring tools to monitor the uptime of our services. If there is a downtime, the user must report the same via ticket within 72 hours of said downtime. If the user fails to report the downtime, he or she will be ineligible for the downtime credit.
The uptime of our services is defined by our monitoring tools and may differ from the tools used by the user. In that case, the uptime shown on our own status page is prioritized.
In the event that Arpan Sen Internet Services, LLC is sued or threatened with a lawsuit due to any content hosted by you on our services, you agree to pay for all the fees and the settlement costs. You also agree to reimburse us for all the fees we may pay to defend ourselves in a court of law.
By using our services, you agree to binding arbitration. In the event of a dispute or claim against Arpan Sen Internet Services, LLC, you agree that such matters will be resolved by an arbitrator of our choosing and that any and all decisions rendered by said arbitrator will be final and binding. Furthermore, you are responsible for all costs related to the dispute and any additional costs that we may need to pay for said arbitration.
Arpan Sen Internet Services, LLC holds all the rights to make any changes to this agreement at any time with or without prior notice.
